1.       DEFINITIONS

 

Unless otherwise provided in this Privacy Policy, capitalized terms shall have the following meanings:

 

a) "Co-branded Services" means services that are provided by us and a third party under a common brand or label.

 

b) "Device" means a computer, mobile, or other device used to access the Services.

 

c) "Device Identifier" means an IP address or other unique identifier for the Device.

 

d) "Mobile Application" means an application provided by us on the Device to access the Services.

 

e) "Mobile Device Information" means information about the Device, including the Device Identifier, operating system, and mobile network information.

h) "TPSP" means a third party service provider.

a)         INFORMATION PROVIDED BY YOU

 

We may request that you provide us with certain protected information, which may be collected through various means, including account registration forms, contact us forms, or when you interact with us. This information may include, but is not limited to, email, password, name, address, mobile phone number, zip code, and identification documents such as Aadhar Card, Pan Card, R.C. Book of Vehicle, Driving license, Insurance Policy and P.U.C. We will only collect protected information that is necessary and for lawful purposes related to our services.

 

b)         INFORMATION COLLECTED AS YOU ACCESS AND USE OUR SERVICES

 

In addition to any protected information you provide us, we and our third-party service providers may use various technologies to collect certain information automatically whenever you visit or interact with our services ("usage information"). This usage information may include the browser you use, the URL that referred you to our services, the areas within our services that you visit, and the time of day, among other information. We also collect your device identifier, which is a number assigned to your device used to access our services. If you book via our call center, we may also record calls for quality and training purposes. Usage information may be collected through the use of cookies, and you can choose to deny or accept the use of cookies through your browser settings. However, disabling cookies may affect the functionality of our services. We cannot control the use of cookies by third parties, and third-party cookies are not covered by our privacy policy.

 We may supplement the information we collect from you through our website or mobile application with outside records from third parties.

 

d)  INFORMATION COLLECTED BY MOBILE APPLICATIONS

 

Our services are primarily provided through our mobile application, and we may collect and use technical data and related information, including information about your device, system, and application software, to facilitate software updates, product support, and other services related to our mobile applications. When you use our mobile applications, they may automatically collect and store mobile device information, including your preferred language and country site, the manufacturer and model of your mobile device, your mobile operating system, and the type of mobile internet browsers you use. We also collect information about how you interact with the mobile application and any linked websites, including how often you use the mobile application, actions you take within the mobile application, and how you engage with the mobile application. This information is used to personalize our services and content available through our mobile application.

 

3       3.  USE OF INFORMATION COLLECTED

 

a) Our primary objective in collecting your information is to provide an enhanced user experience while using the Services. We collect and analyze your information to monitor the most commonly used features of the Services, allow you to view your trip history, rate trips, and identify areas for improvement based on usage patterns and geographic locations.

 

b) We will send a welcoming email to verify your username and password based on the Protected Information provided during account registration.

 

c) The information collected from our Mobile Application is used to serve you the correct app version depending on your device type, troubleshoot issues, and, in some cases, for marketing purposes.

 

d) Your Internet Protocol (IP) address is used to diagnose problems with our computer server and administer our web site(s). It is used to identify you but contains no personal information.

 

e) We may send strictly service-related announcements on rare occasions when necessary, such as when the Services are temporarily suspended for maintenance. You can deactivate your account if you do not wish to receive these.

 

f) The information obtained from you may be used to prevent, discover, and investigate violations of this Privacy Policy or any applicable terms of service or terms of use for the Mobile Application, as well as investigate fraud, chargeback or other matters.

 

g) We provide some of your Protected Information (such as your name, contact number, Vehicle Number, and other documents related information) to the customer for their decision-making.

 

h) The geo-location information is used for various purposes, including sending promotions and offers and allowing you (if you choose through any features we may provide) to share this information with other people.

 

i) Your Protected Information or Usage Information may be used to provide information or services, process transactions, enable participation in various features of the Services, contact you with regard to your use of the Services, for internal business purposes, inclusion in our data analytics, and purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

 

j) We may use the information collected from you for targeted advertising, which involves using information collected on an individual's web or mobile browsing behavior, such as the pages they have visited or the searches they have made, to select which advertisements should be displayed to a particular individual on websites other than our web site(s). The collected information is only linked to an anonymous cookie ID (alphanumeric number) and does not include any information that could be linked back to a particular person, such as their name, address, or credit card number.

 

 

4.    HOW AND WHEN DO WE DISCLOSE INFORMATION TO THIRD PARTIES:

a)    CONSENT TO RECEIVE INFORMATION FROM THIRD PARTIES:

We employ third party individuals and companies to perform certain aspects of the Services on our behalf, such as drivers and the companies they work for, third parties that host the Services, track the Services' analytics, process payments, provide customer support, and perform technical services. These third parties will have access to user information, including Protected Information, only to carry out the services they are performing for you or for us. Each of these third parties is required to ensure the same level of data protection as us and is obligated not to disclose or use Protected Information for any other purpose. Analytics TPSPs may collect information through their own cookies, web beacons, and embedded scripts.

 

c)       CO-BRANDED SERVICES:

 

Certain aspects of the Services may be provided to you in association with third parties ("Co-Branded Services"), such as sponsors and charities, which may require you to disclose Protected Information to them. If you choose to register for products and/or services through the Co-Branded Services, you shall have deemed to consent to providing your information to both us and the third party. Your Protected Information may be disclosed to the identified third parties for that Co-Branded Service and will be subject to their posted privacy policies if you sign-in to a Co-Branded Service with a username and password obtained through our Services.

 

d)    CONTESTS AND PROMOTIONS:

 

We may offer Promotions through the Services that may require registration. By participating in a Promotion, you are agreeing to official rules that govern that Promotion, which may contain specific requirements of you, including allowing the sponsor of the Promotion to use your name, voice, and/or likeness in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, you agree that your Protected Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.

 

e)    ADMINISTRATIVE AND LEGAL REASONS:

 

We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information, including Protected Information, IP address, Device Information or geo-location data, to government or law enforcement officials or private parties, if we reasonably determine it to be necessary and appropriate to satisfy any applicable law, regulation, subpoenas, governmental requests, or legal process, to protect and/or defend the Terms and Conditions for online and mobile Services, to protect the safety, rights, property, or security of the Company, our Services, or any third party, to protect the safety of the public for any reason, to detect, prevent or otherwise address fraud, security or technical issues, and/or to prevent or stop activity that we may consider to be, or to pose a risk of being, an illegal, unethical, or legally actionable activity.

f)     INFORMATION SHARING

Protected Information may be collected and disclosed to third parties if you knowingly and intentionally upload, share, or transmit content from the Mobile Application to an email recipient, online community, website, or to the public. This content may include uploaded photos, posted reviews or comments, or information about you or your ride that you choose to share with others through features provided on our Services. Any content that you upload, share or transmit will also be subject to the privacy policy of the email, online community website, social media or other platform to which it is uploaded, shared or transmitted.

g)    BUSINESS TRANSFER

We may disclose and transfer your information, including your Protected Information and Usage Information, to our parent, subsidiaries and affiliates for internal purposes. Additionally, we reserve the right to disclose and transfer all such information to: (i) a subsequent owner, co-owner or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, restructuring, sale of substantially all of our membership interests and/or assets or other corporate change, including during the course of any due diligence process.

other platform to which it is uploaded, shared or transmitted.

We may disclose and transfer your information, including your Protected Information and Usage Information, to

our parent, subsidiaries and affiliates for internal purposes. Additionally, we reserve the right to disclose and

transfer all such information to: (i) a subsequent owner, co-owner or operator of the Services or applicable

database; or (ii) in connection with a corporate merger, consolidation, restructuring, sale of substantially all of our

membership interests and/or assets or other corporate change, including during the course of any due diligence

process.

 

f.      THIRD PARTY CONTENT AND LINKS TO THIRD PARTY SERVICES

The Services may contain content provided by third parties who may collect information about your website usage

and your Device Identifier when web pages from any online or mobile Services are served to your browser.

Additionally, while using the Services, you may be directed to other sites or applications that are operated and

controlled by third parties over which we have no control. We are not responsible for the privacy practices of these

third parties. For instance, clicking on a banner advertisement may redirect you from one of our websites to a

different web site. Such sites may send their cookies to you, collect data or solicit Protected Information, and may

or may not have their own published privacy policies. We urge you to take note when leaving our Services and to

read the privacy statements of all third-party web sites or applications before submitting any Protected

Information to third parties.

 

6                    6. SOCIAL MEDIA FEATURES AND WIDGETS

 

Our online and mobile Services may include social media features such as the Facebook Like button and widgets such as a "Share this" button or interactive mini-programs that run on our online and mobile Services. These features may collect your IP address, photograph, which page you are visiting on our online or mobile Services, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our online Services. Your interactions with these features and widgets are governed by the privacy policy of the company providing them.

 

7                    7. INFORMATION COLLECTED BY DRIVERS

 

This Privacy Policy does not cover any information about you obtained by the driver or the company to which the driver belongs while providing you with a ride on a cab booked by you after searching for information on the platform or otherwise, which is not provided by us.

 

8                   8. CHANGE OF INFORMATION AND CANCELLATION OF ACCOUNT

 

a)    You are responsible for maintaining the accuracy of the information you provide to us, such as your contact information provided as part of account registration. If your Protected Information changes or if you no longer wish to use our Services, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through the email address mentioned on our website or Mobile Application. We will make a good faith effort to make requested changes in our database then active databases as soon as reasonably practicable.

 

b)    You may also cancel or modify your communications that you have elected to receive from the Services by following the instructions contained within an e-mail or by logging into your user account and changing your communication preferences.

 

c)    If we find it difficult to permit access to our Services to you due to insufficiency/inaccuracy of the information you have modified or changed, we may, at our sole discretion, terminate your access to the Services by providing a written notice to this effect on your registered email id.

 

d)    If you wish to cancel your account or request that we no longer use your information to provide you services, contact us through our email address mentioned on our website. We will retain your Protected Information and Usage Information for as long as your account with the Services is active and as needed to provide you with services. Even after your account is terminated, we will retain your Protected Information and Usage Information (including transaction history) as needed to comply with our legal and regulatory obligations, resolve disputes, conclude any activities related to the cancellation of an account, investigate or prevent fraud and other inappropriate activity, enforce our agreements, and for other business reasons. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes.

 

9                                    9. SECURITY 

 The Protected Information and Usage Information collected by Searchsavaari is stored in a secure manner within    our databases. We have implemented standard, industry-wide, commercially reasonable security practices including encryption, firewalls, and SSL (Secure Socket Layers) to safeguard your information. However, it should be noted that no security system is entirely impenetrable, and we cannot guarantee the absolute security of our databases. We also cannot guarantee that the transmission of information over the Internet or wireless communication will not be intercepted. Any information transmitted to Searchsavaari is done so at your own risk. We strongly advise that you do not disclose your password to anyone.

 

10. GRIEVANCE OFFICER

 

Searchsavaari hereby designates the Searchsavaari Director as the grievance officer for the purposes of the rules established under the Information Technology Act, 2000. The Searchsavaari Director may be contacted at searchsavaari@gmail.com to address any grievances relating to this Privacy Policy or the usage of your Protected Information or other data.

 

11. CHANGES TO THE PRIVACY POLICY

 

Searchsavaari reserves the right to modify this Privacy Policy from time to time in order to reflect any changes to our information practices. Any changes made to the Privacy Policy will become effective immediately upon their posting on the Services. In the event of any material changes to the Privacy Policy, we will notify you by email (sent to the email address specified in your account) or through a notice on the Services prior to the changes becoming effective.      12. BACKGROUND LOCATION ACCESS

Our app collects location data in the background to enable trip-tracking and trip-sharing features, even when the app is closed or not in use. This allows users to share their live location with others during a trip, ensuring accurate and real-time updates for safety, coordination, and convenience. We do not use your location data for advertising purposes or share it with third parties for marketing. You may disable location access at any time from your device settings, but doing so may limit the functionality of trip tracking and sharing.
